Online Orders
Submitting an order does not guarantee that it can be fulfilled.
An order is accepted when it is confirmed by us or by the relevant ordering platform. We may decline or cancel an order where:

The order cannot reasonably be fulfilled

Where we cancel an order after taking payment, the amount paid for the cancelled item will be refunded.
Prices and payment
Prices will be those shown when the order is placed and include VAT where applicable.
Payment is processed through the payment provider shown at checkout. Additional terms and privacy information from that provider may apply.
Collection and delivery
Collection and delivery times are estimates rather than guarantees unless we have specifically agreed otherwise.
Customers should collect orders at the agreed time. Food quality may deteriorate where an order is collected late.
We are not responsible for delays caused by circumstances outside our reasonable control, but we will take reasonable steps to contact you and minimise disruption.
Allergens and dietary requirements
Allergen information is available before ordering and should also be provided with or when the food is handed over.
Please tell us about any allergy or intolerance before completing your order.
Our kitchens handle a range of allergens. Although we have allergen procedures and take reasonable care, we cannot guarantee that products will be completely free from unintended traces of allergens unless this has been expressly confirmed.
Recipes and supplier ingredients can change, so customers with allergies should check the information each time they order.
Online and telephone food orders are distance sales, and allergen information must be available before the purchase is completed and again when the food is supplied.
Cancellations and refunds
Food and drink prepared for collection or delivery is perishable. The general 14-day cancellation right applicable to many online purchases does not normally apply to perishable food.
You may request to cancel an order before preparation has begun. We cannot guarantee cancellation once ingredients have been prepared or the order has entered production.
You remain entitled to an appropriate remedy where food is faulty, unsafe, not as described or not supplied with reasonable care.
We will not normally provide a refund merely because:

The customer fails to collect it

A personal taste preference differs where the product was prepared correctly and as described
Nothing in these terms limits rights that cannot legally be excluded.
Custom and catering orders
Custom, wholesale, catering or large orders may be subject to separate written terms covering deposits, final numbers, changes and cancellation deadlines.
Any additional terms will be provided before the booking is confirmed.
Gift cards
Gift cards are subject to any specific conditions displayed when purchased, including their period of validity, permitted uses and any restrictions.
Gift cards cannot usually be exchanged for cash except where required by law.
Third-party websites
Our website may link to Square, delivery platforms, maps, social-media services and other third-party websites.
Those services are operated independently and have their own terms and privacy policies. We are not responsible for the content or availability of third-party websites.
Intellectual property
The website and its content, including its wording, branding, illustrations, photographs, graphics, menus and logos, belong to Devon Wave Trading Company Limited or are used with permission.
You may view and share links to the website for personal, non-commercial use. You may not reproduce, modify or commercially use its content without written permission.
Our responsibility
We do not exclude liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
